Thank you for using COVESTO (“Website”) Services. These Terms of Use, together with COVESTO Privacy Policy, shall apply to the users of the website as and when they visit, browse, access data and, place orders, upload or download documents, access or otherwise use the Website.

By using the Website, you acknowledge and signify that you have read, understood, and agree to be bound by these Terms and Conditions.  You must agree to these Terms and Conditions in order to access or use the Website. You should not use the services if you do not accept the terms or are unable to be bound by the terms.

The Terms of Service is an Electronic Record as per Section 2 (1) (t) of Information Technology Act, 2000 and rules made there under and all the related amended provisions as applicable to electronic records under various laws as amended by the Information Technology (Amendment) Act, 2008. With reference to section 4 of the Information Technology Act, 2000 the terms of service is legally recognized and Section 10A gives validity of Contract in Electronic Mode as other contract as per Indian Contract Act, 1872.

The terms of service is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing of the rules and regulations, privacy policy and user agreement for access or usage of the intermediary’s computer/digital device resource by any person.

This terms of service is an agreement entered into between the users (“User”, “you”) and COVESTO (“our”, “us”, “we”) and is a legally binding agreement. This is generated by a computer system and does not require any physical or digital signatures for offer or acceptance. And it governs the terms on which Users can avail the services from the website.

The following terms are regarded as:

“Account” means the account created by the User to access and avail the user services.

“Registration Data” means mobile no, email address, permanent address, identity proof etc.

“Services” refers to the services mention on the website to be rendered.

“User” refers to any person who access or visit the website and use, post, read, interpret any form of educational information regarding financial services including but not limited to securities, derivatives, options market through any electronic devices (herein may also refer as you and your).

Other trademarks, service marks, graphics and logos used in connection with the website are the trademarks of the respective owners (collectively “Third Party Trademarks”). COVESTO Trademarks and Third Party Trademarks should in no event be ever copied, imitated or used, in whole or in part, without the prior written permission of the designated trademark holder/owner. The Website and the content featured in the Website are protected by copyright, trademark, patent and other intellectual property and proprietary rights and you are strictly advised to exercise caution with respect to the same.

Updating of Terms

We may at any point in time change/alter/amend our policies and services, so as to reflect accurately reflect our Terms of Service. Unless otherwise required by law, we will notify you before we make any changes to these Terms and give you an opportunity to review them before they come into effect. Should you continue to use the Service after such amendment, you shall be bound by the amended Terms. You may delete your account should you not agree with the amended terms.

Termination

We reserve the exclusive and unhindered right to refuse, move or remove any content posted on the Website, deactivate or delete your accounts and all related information and files in your account at any point in time with or without cause, and with or without any prior notice for any violation of the Terms of Use by the user. Upon such termination or suspension, your right to use the websites will immediately cease and any unauthorized usage shall be punishable under the applicable laws.

You can also terminate your account at any time but your information may remain stored in archive on our servers even after the deletion or termination of your account.

Governing Law

This Website originates from the Raipur, Chhattisgarh. The Agreement shall be governed by the Laws of India including the laws of the State of Chhattisgarh. By using this Website, you consent to the jurisdiction in connection with any action, suit, proceeding or claim to arise under or by any reason of this Agreement. No suit, proceeding or claim to enforce the provisions of this Agreement, or claim to recover any damages for breach or default as per the agreement, could be entertained other than in exclusive place of jurisdiction of Raipur, Chhattisgarh.

Any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the Services or these Terms, including those relating to its validity, its construction or its enforceability (any “Dispute”) shall be first mandatorily submitted to mediation proceedings in terms of the Indian law. If such Dispute has not been settled within sixty (60) days after a request for mediation has been submitted under the Indian laws, such Dispute can be referred to and shall be exclusively and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (“Act”). The Dispute shall be resolved by one (1) arbitrator to be appointed by COVESTO. The place & seat of both mediation and arbitration shall be Raipur, Chhattisgarh, India. The language of the mediation and/or arbitration shall be English. The existence and content of the mediation and arbitration proceedings, including documents and briefs submitted by the parties, any correspondence from the mediator, and correspondence, orders and awards issued by the sole arbitrator, shall remain strictly confidential and shall not be disclosed to any third party without the express written consent from the other party unless: (i) the disclosure to the third party is reasonably required in the context of conducting the mediation or arbitration proceedings; and (ii) the third party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website, Services or Agreement must be filed within one (1) year after such claim or cause of action arose or be barred.

This term of service shall deemed to have been suspended for the period during which we are prevented, hindered or delayed from performing our obligation mentioned in the agreement by the reason of or any cause beyond the control of the company hereunder due to the earthquake, flood, pandemic, epidemic, fire, storm, other natural disasters, act of God, war, terrorism, armed conflict, labor strike, lockout, lockdown or boycott.
